Terms and Conditions

AMS & Mainframe Technologies Terms & Conditions

These are the terms and conditions on which All Media Solutions & Mainframe Technologies (“we” or “us” or “our”) is willing to trade with you. Any variation to these terms and conditions must be in writing and signed by an authorised officer of All Media Solutions or Mainframe Technologies.


Returns

Any refunds for purchases made from the All Media Solutions web site or All Media Solutions physical store location must comply with the terms and conditions stated below:

  1. Proof of Purchase documents must be presented along with the product(s) to be refunded.  These documents are the Receipt/Packing Slip which are presented to you as proof or your purchase in store or sent to you with the product(s).  An Order Confirmation is not Proof of Purchase.
  2. Refunds for any purchases more than 30 business days from the date of the Transaction of Funds will NOT be accepted.
  3. We will refund the amount paid for the product(s) only.  Any servicing fees such as labour charges and freight costs will NOT be refunded.
  4. Product(s) to be refunded must be presented in the Original packaging.  We will reject any refund requests if there is/are missing component(s) in the Original packaging or if the product is not returned in a resalable conditions.
  5. Any serialized product(s), that is, product(s) with serial numbers, must be the same product(s) as indicated in the Tax Invoice/Receipt/Packing Slip provided with the product(s) at the time of purchase.
  6. Any physically damaged product(s) will not be refunded, unless otherwise agreed by us in writing before you ship the product(s) back.  It is your responsibility to ensure the product(s) are securely packaged and wrapped before sending them back to us.
  7. We are NOT liable for any missing goods or damage occurred in transportation from your premises to ours.
  8. Refunded amounts will be credited to you via the same method you used for your payment For example, if the payment method was by credit card, refunded amounts will be credited into the same credit card account.
  9. All deliveries will be through our preferred courier companies unless otherwise specified.
  10. All Media Solutions will NOT guarantee delivery schedules. All delivery inquiries should be referred directly to the courier company.
  11. Delivery costs do NOT include any insurance unless otherwise specified or requested.  Additional charges will apply for insurance.
  12. All Media Solutions cannot guarantee the availability of all goods ordered however if there is any stock shortage, All Media Solutions will contact and advise you accordingly.
  13. Upon request All Media Solutions may in certain circumstances (if the product/s is in a resalable condition) accept a product for return with a 20% re - stocking fee deducted from the refund given to you the customer.
  14. Upon receipt of the return product with your full details provided, we will supply you with a Return Authority (RA) Number by email. We will test and repair the product, or in some circumstances, we may need to refer the product to the manufacturer for testing.
  15. If the product is not DOA or damaged in delivery and in full working condition or any defect or damage was caused after you took delivery of the product, we will return the product to you. You will be invoiced the costs of testing the product and freight for the return of the product to you.
  16. If the product is incorrectly delivered, you must return the product (preferably unopened) with suitable packaging (packed in a cardboard box and have 1 inch of foam or suitable packaging material) to prevent damage in delivery. We will arrange for the correct product to be delivered to you, or you may arrange a refund with our Customer Service Centre.

LIMITATION OF LIABILITY

 

1.1          Except as required  by any provisions of the Trade Practices Act, 1974 or any relevant State Act all express or implied conditions, warranties, undertakings and  covenants cannot be excluded under the provisions of the Trade Practices Act, 1974 or any other relevant State Act the Customer’s sole and exclusive remedy for any breach of a condition, warranty, undertaking or covenant hereunder shall as All Media Solutions may determine be limited to any one of the following :

i.                from the date of invoice and from the period specified thereon for those particular Goods:

The replacement of the relevant Goods or the supply of equivalent goods provided that any defect has developed under proper and normal conditions of use and maintenance of the Goods by the Customer: or

ii.                the repair of the relevant Goods; or

iii.                the payment of the cost of replacing the relevant Goods or of acquiring  equivalent goods if available at the time; or

iv.                the payment of the cost of having the relevant Goods repaired.

All Media Solutions may at its discretion determine which of the foregoing limits shall apply in any case.

1.2          Save as provided in Clause 1.1, All Media Solutions shall not be liable to the Customer or any other person claiming under the Customer or any other person claiming under the Customer in contract or in tort for, or in respect of any direct indirect or consequential loss, damage or expense suffered by the Customer arising out of, or in connection with, or relating to the performance or any breach by All Media Solutions or any of its employees, servants or agents or any of these terms and conditions or any matter  relating to the supply of goods or services or any error (whether negligent or not) information  supplied to the Customer before or after the supply of Goods and / or services “Consequential Loss” shall include but not be limited to loss of profit, use or goodwill(or similar financial loss) and payment made or due to any third party, or any loss or damage caused by delay in the provision of any service, together with any expenses incurred by the Customer in connection therewith or arising there from, or incurred in mitigation or attempted mitigation of such loss or damage.

1.3          Without derogation from or limitation to any other provisions of these terms and conditions and subject to Clause 1.1, it is expressly agreed that in the event that there may be found to exist some liability by All Media Solutions to the Customer or any person claiming under the Customer in contract or in tort arising out of, in connection with, or relating to the performance or any breach of any of these terms and conditions or any matter relating thereto, or error (whether negligent or not) in the information supplied to the Customer before or after the supply of the Goods then All Media Solutions liability shall not exceed in total the amount paid to All Media Solutions pursuant to the supply of the Goods in relation to which the liability arose after deduction from such payment of all freight, taxes, duties and other amounts payable by Leader to third parties.  The loss or damage referred to above shall mean and include without limiting the forgoing loss or damage caused by the negligence or willful, legal or other act or default of All Media Solutions or any of its employees, servants or agents whether or not such loss or damage is foreseeable or contemplated by All Media Solutions.

 

Shipping

All deliveries will be through our preferred courier companies unless otherwise specified.

Delivery costs do NOT include any insurance unless otherwise specified or requested.  Additional charges will apply for insurance.

All Media Solutions cannot guarantee the availability of all goods ordered however if there is any stock shortage, All Media Solutions will contact and advise you accordingly.

All items purchased from All Media Solutions are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

All Media Solutions will NOT guarantee delivery schedules. All delivery inquiries should be referred directly to the courier company, in the circumstance that you are unable to contact the courier or courier company call All Media Solutions and we will endevour to find your shipment.

Delivery dates and times quoted for delivery of goods, or the provision of services, are estimates only and All Media Solutions shall not be liable for any loss or damages howsoever arising as a result or consequence of any failure to deliver or delay in delivery of any goods or services arising from any circumstances. Customers shall not be relieved of any obligation to accept or pay for goods or services by reason of any delay in delivery, despatch or performance. All media Solutions reserves the right to deliver by way of partial shipments and each partial shipment shall be deemed to be sold under a separate sales contract. No cancellation of sales contract is allowed if goods or services have been delivered by the courier. We may charge you storage, handling and re-delivery fees if you are unable to take delivery of our product at the time we deliver our product to you.

 

PRICING

Except where noted otherwise, the List Price displayed for products on our website/s represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The List Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. For certain items that are offered as a set, the List Price may represent "open-stock" prices, which means the aggregate of the manufacturer's estimated or suggested retail price for each of the items included in the set.

With respect to items sold by All Media Solutions, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If an item's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

R.R.P’s shown are indicative only. There is no requirement to comply.

Warranty Claims

All Media Solutions Covers all (with exception to phone & used components repairs) component parts for a 1-year parts limited manufacturer warranty unless specified otherwise by All Media Solutions.

Bright or dead pixels on LCD Monitors do not automatically mean that the TFT is faulty or DOA unless the model purchased is specified by All Media Solutions to come with a zero dead pixel warranty. Unless a dead pixel check is paid for, all freight charges to and from All Media Solutions for exchange of units will be borne by customer.

Many goods including, but not limited to, most monitors, printers and component parts are covered by “direct” manufacturers' warranties. Any claims in these circumstances cannot be handled by All Media Solutions and the customer must contact the manufacturer or its agent for warranty claims.

Any goods returned for repair found by All Media Solutions to be free of faults or goods with physical damage or damage caused by improper use are not covered by warranty. The customer shall be liable for a handling and service fee of $22 for components or $33.00 (incl GST) Base Fee (30 mins) + $50.00/hour thereafter, including shipping costs if applicable.

No warranty claims will be accepted without a proof of purchase provided by the customer. The invoice is to be presented for any claims, and labour will be charged if goods are found by All Media Solutions not to be free of faults.

Any unauthorised returned goods will not be accepted and will be sent back at customer's cost. Goods under warranty must be transported to All Media Solutions at the customer's cost and returned in their original packaging. For Dead on Arrival (DOA items) – the full set of accessories including the manuals, driver CD's, all cables, original packing materials, etc must be returned together with the DOA unit.

All Media Solutions will not accept, refund or replace any damaged goods caused by overclocking, (operating goods beyond their specifications), misuse or improper handling.

Customers who choose to overclock any equipment do so at entirely their own risk and accept that by doing so they have voided all warranties.

Failure of equipment to overclock will not be accepted as any basis for a claim for faulty goods.

Repairs or replacements under the terms of warranty do not give rights to extensions or a new beginning of the warranty period and the remainder of the original warranty will apply. Repairs or replacements may be carried out with functionally equivalent reconditioned parts.

All shipping costs for goods returned to All Media Solutions will be borne by the customer for warranty returns / claims.

All Media Solutions takes all due care in servicing all goods, however All Media Solutions accepts no liability whatsoever for any form of damage or loss of the aforementioned goods arising during servicing. All Media Solutions will not be responsible for any loss of data in any form and it is the responsibility of the Customer to backup all data before bringing any goods to All Media Solutions for servicing.

Warranty is not transferable. Warranty will be voided if goods are found by All Media Solutions to have any physical damage, unclear barcode labels, burnt-out chipsets or components due to inappropriate customer handling and use after labels are removed.

RMA policy on warranty provided by All Media Solutions are limited to those provided by the manufacturer in it’s RMA Policy.

Intel and AMD CPU Warranty claims' returns must include the fan/heatsink or warranty will become void.

Warranty does not cover damage to other equipment used in conjunction with goods supplied by All Media Solutions.

Warranty does not cover damage caused by power surges, or any acts of God.

In the case of goods that are returned in a damaged condition, All Media Solutions reserves the right, it its discretion, to declare the goods “Beyond Repair”. All Media Solutions will replace the goods, at the customer's cost, with new goods with applicable new warranties. In the event that parts are salvaged from the damaged goods and used in the new goods, whatever warranty remains on those salvaged parts will apply.

Customers who have warranted items, which are no longer available, will be offered an equivalent product or the choice to upgrade at All Media Solutions discretion.

Under no circumstance can opened software be returned.

All Media Solutions makes no warranty in relation to the Products or Services other than as contained in these Terms or as prescribed by a law which cannot be excluded or, in the case of Products, as provided by the Products’ respective manufacturers. Defects in Services which are reported to Express Data within 30 days of delivery of the Service will be rectified by All Media Solutions at no charge to the Customer. All Media Solutions will not provide claimed warranty services for defects or deficiencies in Products or Services which are caused by:
(a) external causes including natural disaster, fire, accident, neglect, misuse, vandalism, water, lightning, power surge or spike;
(b) the use of a Product for other than its intended purpose;
(c) the use with or connection of a Product to items not approved by All Media Solutions;
(d) the performance of maintenance or attempted repair by persons other than All Media Solutions or as authorised by All Media Solutions;
(e) any configuration or reconfiguration by the Customer.
22.2 Products validly returned will only be credited to the Customer’s account if they are returned in the same condition as delivered to the Customer and if received by All Media Solutions within 21 days from delivery.

 

Your Relationship with Us

1. Nothing in these terms and conditions creates any relationship of employment, agency or partnership between you and us.

 

Water Damaged Electrical Devices

Water and electrical components are a dangerous mix. We cannot guarantee or warranty any repairs we do on water damaged items. That said we will do all we can, within reason, to try to repair and bring your electrical devise back to full functionality, we also have a very good history of being able to do so.

When we repair your water damaged electrical devise it is our goal to have the device functioning at basic usability. This is what our base price of $130 covers. In the case of a mobile phone the $130 water damage payment will cover All Media Solutions bringing your phone back to basic mobile phone capabilities ie the phone will be able to take and make calls & send and receive text messages. That price repair does not guarantee that the wifi, camera/s, picture messages, apps, contacts, internet, time & date & other non essential phone capabilities will be able to be brought back into full functionality.

It is only when the phone cannot make calls and or receive text messages that you will receive either a refund or only be charged the $50 service fee for our time spent on your device.

 

Existing Mechanical Defects Uncovered During Repair

All Media Solutions takes all due care in servicing all goods, however All Media Solutions accepts no liability whatsoever for any form of damage or loss of the aforementioned goods arising during servicing / repair/s. All Media Solutions will not be responsible for any loss of data in any form and it is the responsibility of the Customer to backup all data before bringing any goods to All Media Solutions for servicing.

When electrical or mechanical devices are dropped, on occasions, there can be more damage incurred to the device than can be seen on the surface or in normal every day use and are not uncovered until the device is in repair / servicing, for example if you drop your phone you may only notice that the screen is broken and not working to optimal usability, but when you dropped the phone unknowingly you have also broken the camera and it is only when the device is opened that the camera issue is uncovered, you accept that this is a possibility and you consent to All Media Solutions accepting no liability whatsoever for any form of damage or loss of the aforementioned goods arising during servicing / repair/s.

 

 

Dead pixels

Bright or dead pixels on LCD Monitors & Laptops / Notebooks do not automatically mean that the TFT is faulty or DOA unless the model purchased is specified by All Media Solutions to come with a zero dead pixel warranty. Unless a dead pixel check is paid for, all freight charges to and from All Media Solutions for exchange of units will be borne by customer.

Manufacturers have different policies on what is deemed to be normal amounts of dead or stuck pixels. Some Manufacturers have a zero dead pixel warranty on monitors others have requirements of over seven or more dead pixels. These dead pixel standards also apply to laptops / notebooks & other forms of display. All Media Solutions has to abide by the manufacturers policies and can only refund or exchange these products if they are deemed faulty by the manufacturer of those products.

In order for you to receive a DOA refund or exchange on your product you will need to get a Case Number from the manufacturer of the product. They will need the serial number or “SNID” of your product when you call them; the numbers of most major manufacturers is listed in a section below labeled “warranty contacts”.

When you receive a case number from the manufacturer this does not automatically mean you will receive a refund or an exchange for your product.

Further information. Each Pixel is made up of a Red, Green and Blue sub-pixel. When a sub-pixel is fixed in an unchanging state, the visible result is a tiny black, white or colored spot that appears on the screen. There are generally two types of sub-pixel defects namely Bright and Dark sub-pixel defects.
A sub-pixel defect is also referred to as a dot defect.
Bright Sub-Pixel defects: A sub-pixel remains permanently lit, resulting in a white or colored dot on a Black background.Dark Sub-Pixel defects: A sub-pixel remains permanently unlit, resulting in a black or colored dot on a White background.
During LCD manufacturing process, it is not uncommon for one or more sub-pixels to become fixed in an unchanging state. A display with 1 to 5 fixed sub-pixel is considered normal and within industry standards

Governing Law

These terms and conditions are governed by, and you agree to submit to, the laws applicable in the State of Queensland, Australia.

Payments

In the event of any default in payment to All Media Solutions for more than 60 days by the customer or where a demand has been made against a guarantor of a customer’s account, All Media Solutions may in its absolute discretion record the default with its credit information provider.

All Customer/s orders for goods whether in stock or awaiting delivery to All Media Solutions can, at All Media Solutions discretion, require a 30% deposit or full payment of said goods before they will be ordered by All Media Solutions.

Any deposit / partial payment for goods that have not been paid in full by 7 days of the initial deposit will be restocked and any deposit/ partial payment from said goods will be kept as payment by All Media Solutions for a re-stocking fee / covering costs incurred for products devalued from use in building or repairing items, unless All Media Solutions is at fault for this delay of build or products ordered.

Product/s sold for $2500.00 and over ordered for customers or custom built / set up can & normally will incur a minimum 50% initial deposit before the sale proceeds. If the Product/s are not paid in full by the customer within 3 business days of said goods arrival in our store or completion of build / setup then the 50% initial deposit will be the property of All Media Solutions in order to cover labour costs, freight & insurance of goods, time spent ordering / researching the goods presale, goods that have been opened being possibly sold at a discounted price and the restocking of goods. There are circumstances where only 20% of the end sale price of unopened goods will be kept by All Media Solutions, and 35% kept for system builds.

 

Electronic Communication

When you visit All Media Solutions website/s or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or SMS or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All Media Solutions may contact you via SMS or email in regards to promotions or to let you know about the progress of an order / repair, you consent to receive such electronic messaging, and if you choose to opt out of such electronic communications please contact us and we will remove you from our mailing lists.

Electrical Components/ Computer Parts

All customers of All Media Solutions purchasing (either in store or online) computer; parts, hardware, components, software etc for; upgrading, maintaining, building, or performing any form of manual labor on computers or computer related systems are agreeing that they are a qualified technician or under direct supervision of a qualified technician at all times whilst performing these activities listed above. All Media Solutions is not responsible for any injury caused from the sale and subsequent use of products purchased from All Media Solutions, whether they are products for general home or office use, or computer parts for upgrades / repairs be it by a qualified technician or those supervised by a technician.

It is the responsibility of the Customer to ensure, when ordering that all Goods ordered are in conformity with the Customer’s requirements.

The Customer acknowledges that All Media Solutions has not made any warranty or representation, express or implied, in relation to the Products or the Services, including whether they are suitable for a particular purpose (whether such purpose was made known to All Media Solutions or not), unless provided in writing.

OEM software sold by All Media Solutions to customers will only be used in line with the manufacturers stated purpose for use.

Quotations.

1. Quotations expire within 14 days or at the end of the current month, whichever comes first unless otherwise specified in the quotation. Whilst all reasonable care has been taken in preparation of a quote, All Media Solutions does not warrant and is not liable in any way for the accuracy of product specifications, availability, configuration, or quoted prices and the Customer acknowledges that this information is subject to change without notice.

Confirming Prices

Items in your Shopping Cart will always reflect the most recent price displayed on the item's product detail page. This price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart doesn't reserve the price shown at that time. It is also possible that an item's price may decrease between the time you place it in your cart and the time you purchase it.

Some discounts are limited-time offers. The discount we are able to offer for any item is dependent upon its availability, All Media Solutions price will necessarily change on occasion.

LAW

 

All sales are deemed to be made in the State of Queensland, and shall be governed and construed in accordance with the Laws of the State of Queensland and with the Commonwealth of Australia.

 

 

SEVERABILITY

 

1.In the event that any or any part of these terms, conditions or provisions shall be determined invalid, unlawful or unenforceable to any extent such terms, conditions or provisions shall be severed from the remaining terms and conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

 

WAIVER

 

1.Failure by All Media solutions to insist upon strict performance of any term warranty or condition of these terms and conditions shall not be deemed a waiver therefore of any rights that All Media Solutions may have and no express waiver shall be deemed a waiver of any subsequent breach of any term, warranty or condition.

 

WHOLE AGREEMENT

 

No modification, variation or amendment to these terms and conditions shall be of any force or effect unless in writing and signed by All Media Solutions.

 

NOTICE

 

Any notice or document required under these terms and conditions to be served on All Media Solutions must be addressed to its registered office for the time being. Any notice or document similarly required to be served on the Customer may be sent to the Customer’s last known address. Notices and documents may be delivered by hand or sent by prepaid post and if sent by post shall be deemed to be served on the day on which they would be delivered in the ordinary course of post. Notices and documents may be delivered by facsimile or electronic email to the parties’ last known facsimile number or email address and shall be deemed to be served at the time of transmission.

 

Agreement.

The terms and conditions contained herein constitute the entire Agreement between the parties and no amendment or variation shall be of any force and effect unless to writing and signed by both All Media Solutions and the Customer. No representations have been made by All Media Solutions or on its behalf which have induced the Customer to enter into this Agreement.
